Domestic Burn Permit

Use this page to obtain a domestic burn permit.  Please read all of the information below and fill out the form at the bottom of the page.


The following requirements apply to all Domestic Open Debris Burning:

  • You are responsbile for any fire, smoke or odors created from open burning and for any amage that results from your fire.
  • A responsible person must constantly attend any open burning.
  • This person must be capable of and have the equipment to extinguish the fire.
  • This person must completely extinguish a fire before leaving it.
  • Burning must be conducted during daylight hours.
  • Burning durning strong or gusty wind conditions is PROHIBITED.
  • The fire cannot create a nuisance or a hazard to public safety.
  • Burning of uncut vegetation is PROHIBITED. All vegetation must be cut and piled prior to burning.
  • No burning can occur during a period when PROHIBITED by the Depart ment of Environmental Quality, the Office of the State Fire Marshal, the Department of State Forestry, or the Nestucca Rural Fire Protection District because of adverse fire safety conditions. (During times of Burn Bans)
  • All paper products shall be burned in an approved burn barrel.  Burning of paper products in open piles is prohibited. All burn barrels shall be covered with a heavy mesh screen made of no less than 14 guage wire and holes no larger than 1/4". Approved burn barrels shall be maintained in a safe manner and shall be placed a minimum of 15' from combustibles, structures, fences and property lines.
  • Open debris piles shall be placed a minimum of 50' from combustibles, structures, fences and property lines.
  • A permit is not required for RECREATIONAL FIRES (small cooking and warming fires). This type of fire is required to be placed a minimum of 25' from combustibles, may not contain debris and must be completely extinguished when not attended.  If you are planning on having a recreational fire on property other than your own, contact the legal owner or agency for permission, possilbe restrictions and legal status

The permittee agrees to abide by the above regulations.  Burn sites may be inspected by fire personnel whenever deemed necessary. Permittee agrees to extinguish any fire when so ordered by a member of the Fire District or by a law enforcement official.  CAUTION: this permit does not relieve the permittee of responsiblity from fire damage as a result of unsafe, reckless or illegal burning.  Failure to comply with these regulations is a misdemeanor under Section 960, Chapter 478, Oregon State Law and DEQ regulations. Violation of regulations may result in revoking of a permit, extinguishment of fire and repayment of incurred costs resulting from illegal fire.
